General Terms and Conditions of Sale

Any special conditions negotiated and accepted in writing between L'Amérique TP and the customer take precedence over these general terms. Any conflicting clause introduced by the customer without the express written acceptance of L'Amérique TP shall be deemed unwritten. Signed quotes, order forms and amendments constitute the contractual reference documents for each transaction.

An order is binding upon written acceptance of the quote, signature of the order form, or payment of a deposit by the customer. L'Amérique TP reserves the right not to confirm an order in the event of temporary unavailability of the product or service, incomplete information or non-payment. The confirmation will detail the nature, quantity, price and agreed delivery times.

Services are performed according to the terms set out in the quote or order form. For equipment deliveries, delivery is made to the address provided by the customer, subject to site accessibility for transport vehicles and machinery. The customer undertakes to make the site available in conditions allowing the work to be carried out (access, clearance, ground stability, signage).

Timescales indicated are estimates in working days and do not constitute a binding commitment, unless expressly stated otherwise in a signed contract. L'Amérique TP endeavours to meet these timescales and will inform the customer of any material change due to weather, supply, site access or force majeure. Delays cannot give rise to compensation if they are beyond the control of L'Amérique TP.

Delivery, material transport and crew travel costs are specified in the quote. Unless otherwise stated, transport costs are not included in the price of products and services. Additional costs related to site constraints (difficult access, sloping terrain, removal of spoil, restricted parking) will be charged as detailed in the quote.

L'Amérique TP carries out deliveries and interventions with its own equipment and staff, or through selected and insured transport and subcontracting partners. The choice of transport method or service provider belongs to L'Amérique TP, unless otherwise agreed with the customer. The liability of carriers or subcontractors is governed by their respective contracts.

Prices are quoted in euros excluding tax (excl. VAT) and including VAT (incl. VAT) as indicated on the quote. L'Amérique TP reserves the right to modify its prices at any time; confirmed orders are invoiced at the prices in force on the day of order. Any variation in supply, transport or labour costs occurring after an order is confirmed may result in an amendment before work begins.

Product sheets, photographs, plans and descriptions presented on the website or in commercial documents are provided for information only and are not contractually binding. Technical characteristics, dimensions and compliance must be verified on the signed quote or order form. L'Amérique TP accepts no liability for misunderstanding based on information not confirmed in writing.

Payment is made according to the terms specified in the quote: bank transfer, cheque or cash within legal limits. A deposit may be required on order. In the absence of full payment by the agreed due dates, L'Amérique TP reserves the right to suspend ongoing services, refuse any new order and demand payment of amounts due, plus applicable late payment penalties.

Personal data collected as part of quote requests, orders and services is processed in accordance with applicable regulations (GDPR). It is used for follow-up, invoicing, delivery and customer relations. Customers have the right to access, rectify, erase and restrict processing of their data. For any data privacy questions, customers may contact L'Amérique TP by email.

As required by law, L'Amérique TP provides on its commercial documents its company name, SIRET number, address, telephone and email contact details, and applicable warranty conditions. The customer undertakes to provide accurate and complete information to enable the order to be carried out (delivery address, site access, contact details).

Products sold benefit from the legal guarantee of conformity and the guarantee against hidden defects, under the conditions of the Consumer Code and the Civil Code. Works services are covered by the mandatory ten-year guarantee where legally applicable, as well as by the perfect completion guarantee. Any specific warranties are set out in the quote or works contract.

For distance or off-premises contracts concluded with a consumer, the statutory fourteen-day withdrawal period applies, subject to the exceptions provided by regulations for services performed before the end of the period with the customer's express consent, custom-made or clearly personalised products, and works requiring immediate execution. For ordinary consumer goods ordered at a distance, return arrangements must be agreed with L'Amérique TP.

All content on the L'Amérique TP website (texts, images, videos, logos, plans, technical documents) is protected by intellectual property laws. Any reproduction, representation, modification or exploitation, in whole or in part, without prior written authorisation is prohibited. Documents, plans and quotes provided to the customer are for strictly personal use and may not be passed on to third parties without consent.
